數(shù)據(jù)主體主導的數(shù)據(jù)流通邏輯與實現(xiàn)路徑研究

摘要： 數(shù)據(jù)上升為全新的生產(chǎn)要素，發(fā)展數(shù)據(jù)要素市場、激活數(shù)據(jù)要素潛能成為全球各國在數(shù)字時代搶占競爭優(yōu)勢的關(guān)鍵抓手，但數(shù)據(jù)資源分散、流通壁壘林立，共享、開放以及交易等流通路徑面臨諸多困境難以破題，數(shù)據(jù)流通的長效機制研究亟待建立。通過深度剖析數(shù)據(jù)控制主體主導的數(shù)據(jù)流通體系，分析其面臨的困境及內(nèi)在原因，充分借鑒全球各國對數(shù)據(jù)流通新路徑的探索與實踐經(jīng)驗，提出了數(shù)據(jù)主體主導的數(shù)據(jù)流通新路徑，包括設計思路、基礎(chǔ)與支撐、實施路徑以及效益分析，為數(shù)據(jù)流通機制探索與模式創(chuàng)新提供參考。

Research on the logic and realization path of data circulation led by data subject

Abstract： As data becomes a new factor of production, the development of data element market and activation of the potential of data element become the key to seize competitive advantages for the countries around the world in the digital era. The problems of decentralized data resources and numerous data barriers are hard to crack. The study of a long-term mechanism of data circulation receives wide attentions. This paper analyzes the facing difficulties and internal reasons of the path of data circulation dominated by the data controllers, absorbing the practical exploration experience of countries around the world on new paths of data circulation. On this basis, the paper put forwards the design ideas, foundation and support, implementation path and benefit analysis of a new path of data circulation, to provide the reference for the exploration of mechanism exploration and mode innovation of data circulation.

0 引言
隨著數(shù)字時代的到來，數(shù)據(jù)已經(jīng)成為未來社會經(jīng)濟發(fā)展的核心戰(zhàn)略資源。全球各國積極制定國家數(shù)據(jù)戰(zhàn)略，激活數(shù)據(jù)要素動能，搶占全球數(shù)據(jù)發(fā)展制高點。推動數(shù)據(jù)要素安全流通和高效配置是加快數(shù)據(jù)要素價值釋放的重要基礎(chǔ)，高效安全的數(shù)據(jù)流通規(guī)則與實現(xiàn)路徑成為全球各國探索與實踐的焦點。歐盟數(shù)據(jù)立法走在全球前列，出臺了《通用數(shù)據(jù)保護條例》《非個人數(shù)據(jù)自由流通條例》等相關(guān)法規(guī)制度，引領(lǐng)著全球數(shù)據(jù)立法的風向標。美、英、日等國的探索起步較早，形成了以“藍綠按鈕”“Midata”“信息銀行”等為代表的個人數(shù)據(jù)管理的新型服務模式。隨著數(shù)據(jù)可攜帶權(quán)的設立，以數(shù)據(jù)主體為主導的個人數(shù)據(jù)流通路徑建設取得了實質(zhì)性突破，典型的如韓國的MyData模式。近來，歐盟《數(shù)據(jù)法》對數(shù)據(jù)可攜帶權(quán)進一步延伸和細化，為數(shù)據(jù)主導的數(shù)據(jù)流通新路徑的探索留下了更大的實踐空間，引發(fā)了更廣泛的關(guān)注。
